What Happens When You File Bankruptcy

Filing Chapter 7 bankruptcy is a fairly quick process that usually takes about 4 to 6 months after you actually file the case. If you file your case electronically, a few minutes after the cases filed you will be given a hearing date. This hearing is called a 341 meeting or first meeting of the creditors. You’re hearing will be held 4 to 6 weeks after you file bankruptcy. All of your deadlines in your case run from this hearing date. Creditors in the United States trustee have 60 days after your hearing to file motions to dismiss your case, object to discharge, or file non-dischargeability actions for specific debts.
