I do not understand the reasoning for trying these people at all. They were captured in another country and are not citizens of this country. By declaring that we have legal advice forum jurisdiction over what goes on in another country with citizens of other countries seems to make this a war of aggression and imperialism: we are claiming legal authority over other citizens. Doesn’t the Constitution already have a method for dealing with extranational activities that we don’t like: declaration of War by the elected representatives. Should the actions of the AG should be reviewed by the Supreme Court before we go any further?
